Privacy Policy, effective as of March 4, 2024
Granum, LLC (“Granum” or “we”, “us” or “our”) is committed to protecting the privacy of individuals who visit our websites (“Visitors”), individuals acting on behalf of a business entity who register to use the Services as defined below (“Customers”), and individuals who register to attend Granum’s corporate events (“Attendees”). “You” is used generally in this Privacy Policy and can refer to a “Visitor”, “Customer” or “Attendee” as the context requires. This Privacy Policy describes Granum’s privacy practices in relation to the use of Granum’s websites and the related applications and services offered by Granum (collectively, the “Services”).
This Privacy Policy does not address: (1) personal information that is collected by Customers (either with or without the use of the Services) regarding their employees (“Customer Employees”); (2) the privacy practices of Granum’s Customers who authorize Granum to collect and process personal information of Customer Employees, including through any geolocation tracking devices (GPS) on automobiles or equipment or dashcams in vehicles; or (3) the data of our Customer’s customers (“Clients”) and Clients’ personnel.
If you are a Customer Employee or a Client: (1) please understand that Granum and Customer are independent parties, and Granum has no control over the Customer’s privacy practices; (2) please review the privacy policy of the Customer to understand the Customer’s practices; and (3) please direct any questions, concerns, or data rights requests to the Customer.
This Privacy Policy covers Granum’s information practices regarding the collection and use of personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws (“Personal Information”) by Granum’s websites that link to this Privacy Policy, including: https://www.granum.com (collectively referred to as “Granum’s websites”).
Required Contact Information
When expressing an interest in obtaining additional information about the Services or registering to use the Services, Granum requires you to provide Granum with Personal Information, such as name, company name, address, phone number, and email address (“Required Contact Information”).
Billing Information
When purchasing the Services, Granum requires you to provide Personal Information regarding billing information, such as billing name and address, (“Billing Information”). We do not store payment card information; rather we utilize a third-party payment processor and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information.
Required Contact Information, Billing Information, and information collected through use of the Services are referred to collectively as “Customer Data” in the case of Customers, or in the case of Attendees, “Attendee Data.”
WebSite Navigational Information
As you navigate Granum’s websites, Granum may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (“WebSite Navigational Tools”). The information we collect from WebSite Navigational Tools includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on Granum’s websites (such as the web pages viewed and the links clicked). Please see Section 5 below for more information about these tools.
Client Data
Granum Customers may electronically submit data or information about Clients to the Services for hosting and processing purposes (“Client Data”). Granum processes Client Data solely on behalf of the applicable Customer and may access and share Client Data as described in this Privacy Policy for the purpose of providing the Services, preventing or addressing service or technical problems, at a Customer’s request in connection with customer support matters, or as may be required by law.
Geolocation Data
Some of Granum’s Services provided to Customer under a subscription agreement allow for the collection of geolocation data of equipment and vehicles and video footage of dashcams in vehicles, which services are offered through a third-party licensor, FleetSharp (www.fleetsharp.com). The Services collect this information solely on behalf of Customer in connection with delivery of Customer’s subscription Services. It is the responsibility of Customer to (1) provide all required disclosures and obtain all required consents of Customer Employees regarding the capture of this data by Granum and its use by Customer, and (2) to contractually require its Clients to provide all required disclosures and obtain all required consents of Client’s personnel regarding the capture of this data by the Services and its use by Customer and Client. If you are a Customer Employee or a Client, please review the privacy policy of the Customer to understand the Customer’s data handling practices and direct any questions, concerns or data rights requests to the Customer. With respect to GPS data, Granum stores: (1) identifying characteristics about vehicles including license plate, VIN Number, and any characteristics that can be determined using the VIN Number; (2) the Granum User ID for the crew lead driving such vehicle and the dates they drove the vehicle; and (3) geolocation data for any tracked vehicles or other devices. Granum does not store or access dashcam data unless we are expressly requested to access the data for troubleshooting or other support purposes.
Granum uses Customer Data to respond to your requests and perform the Services requested. For example: (a) if you fill out a “Contact Me” Web form, Granum will use the information provided to contact you about your interest in the Services; (b) the information the Services collect about Customer and Customers’ employees and Clients are used to administer accounts and provide the Services ordered or requested by Customer; and (c) payment information is used to invoice Customers (and Clients, if authorized by the applicable Customer) and collect payments.
Granum uses Attendee Data to plan and host corporate events, host online forums and social networks in which event attendees may participate, and to populate online profiles for Attendees on Granum’s websites. Additional information on Granum’s privacy practices with respect to Attendee Data may be found in additional privacy policies on the event websites, as the case may be.
Granum may also use Customer Data and Attendee Data for marketing purposes. For example, Granum may use contact information of Customer to contact the Customer to further discuss your interest in the Services and to send you information regarding Granum, its affiliates, and its partners, such as information about promotions or events. Other marketing purposes may include using Customer Data in the aggregate, which would not be personally identifiable, but rather general metrics about all or a segment of Granum Customers.
Granum uses Billing Information to process payment from Customers and Attendees, and if authorized by Customer, by Customer’s Clients.
Granum uses [Customer Data and Attendee Data] to facilitate text message communication through Zoom’s SMS integration services. Granum may use text message communication for the following purposes and with your consent: (a) to confirm appointments and meetings; (b) to provide updates or alerts; and (c) to send reminders or follow-ups. Please refer to section 5 below for additional information about SMS/text message communication.
Granum uses WebSite Navigational Tools to operate and improve Granum’s websites; to monitor and analyze rends and aggregate information; and to protect and prevent against fraud and misuse of the Granum’s websites and Services. Granum may also use information collected via WebSite Navigational Tools alone or in combination with Customer Data and Attendee Data to provide personalized information about Granum.
Granum may also use Personal Information to otherwise provide the Granum’s websites and Services; fulfill any other purpose for which you provide it; to fulfill other purposes as disclosed at the time of collection; to fulfill any legal or regulatory requirements and any of our internal policies; or for any other purpose with your consent.
This section describes the types of Web Site Navigational Tools used on Granum’s websites and how the information collected through those tools may be used.
3.1 Cookies
Granum uses cookies to make interactions with Granum’s websites easy and meaningful. When you visit one of Granum’s websites, Granum’s servers send a cookie to your computer.
Granum uses cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. Please note that if you disable your web browser’s ability to accept cookies, you will be able to navigate Granum’s websites, but you will not be able to successfully use the Services.
3.2. Web Beacons & Pixels
Granum uses Web beacons alone or in conjunction with cookies to compile information about Customers’ and Visitors’ usage of Granum’s websites and interactions with emails from Granum. For example, Granum may place Web beacons in marketing emails that notify Granum when you click on a link in the email that directs you to one of Granum’s websites. Granum uses Web beacons to operate and improve Granum’s websites and email communications.
3.3. Behavioral Remarketing
We may also use remarketing services to advertise on third-party websites to you after you visited our Granum’s websites. For this purpose, visitors are grouped by certain actions on our Granum’s websites, e.g., by duration of a visit. This enables us to understand your preferences and to show you personalized advertising even if you are currently surfing on another website that also participates in the same advertising network. We may utilize Google Ads, Bing Ads, LinkedIn Ads, and similar ad networks.
3.4. Other Tracking Technologies
We may also use tracking technologies to collect “heat mapping” or “clickstream” data, such as the domain name of the service providing you with Internet access, your device type, IP address used to connect your computer to the Internet, your browser type and version, operating system and platform, the average time spent on our Granum’s websites, pages viewed, content searched for, access times and other relevant statistics, and assign unique identifiers to the device or other credentials you use to access the Granum’s websites for the same purposes.
3.5. IP Addresses
When you visit Granum’s websites, Granum collects your Internet Protocol (“IP”) address to monitor the regions from which Customers and Visitors navigate Granum’s websites. Granum also collects IP addresses from Customers when they log into the Services as part of Granum’s “Identity Confirmation” and “IP Range Restrictions” security features.
3.6. Your Choices
Your browser may provide you with the option to refuse some or all browser cookies. You may also be able to remove cookies from your browser. You can exercise your preferences in relation to cookies on our Granum’s websites by taking steps outlined below.
Granum may provide bulletin boards, blogs, or chat rooms on Granum’s websites. Any Personal Information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Granum is not responsible for the Personal Information you choose to submit in these forums.
Customers and Visitors may elect to use Granum’s referral program to inform friends about Granum’s websites. When using the referral program, Granum requests the friend’s name and email address (collectively, “Third Party Data”).. If you use any feature of the Services that allows you to submit Third Party Data, you acknowledge, represent, and agree (a) that you have the authority of the relevant other party for us to access and use the relevant Third Party Data, and (b) that you have notified these other parties and informed them how their information is collected and used by us to provide the Services.
We reserve the right to identify you as the person who has provided the information in any messages that are sent to other parties. We use Third Party Data to (a) contact such party using the Third Party Data provided, and/or (b) to provide the Services requested. Granum will automatically send the friend a one-time email inviting the recipient to visit Granum’s websites
Granum posts a list of Customers and testimonials on Granum’s websites that contain information such as Customer names and titles. Granum obtains the consent of each Customer prior to posting any Customer information or testimonials.
Granum operates social media pages on third party networks and has social media icons on the Granum’s websites. When you visit or link to our social media pages, data is processed both by Granum and the applicable social media provider. Social media providers are unaffiliated with us, and Granum is not responsible for the content or privacy practices of social media providers. Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms. Any information, communications, or material of any type or nature that you submit via public sites (including, but not limited to any social media platforms or websites such as Facebook, Instagram or Twitter) by email, posting, messaging, uploading, downloading, or otherwise (collectively, a “Submission”), is done at your own risk and without any expectation of privacy. We cannot control the actions of other users of any social media platform or website, therefore, we are not responsible for any content or Submissions contained on such social media platforms and website.
Service Providers
Granum may share Personal Information with Granum’s contracted service providers so that these service providers can provide services on our behalf, including without limitation our payment processors, technology providers, and professional advisors. Granum may also share Personal Information with Granum’s service providers to ensure the quality of information provided.
Granum Affiliates
Granum may share Personal Information with other companies in order to work with them, including affiliates of the Granum corporate group. For example, Granum may need to share Personal Information for customer relationship management purposes.
Analytics & Advertising Partners
We may share your Personal Information, including without limitation your contact information with entities that perform marketing or data aggregation services on our behalf, or with which we or an affiliate has joint marketing arrangements. We may share Personal Information, including without limitation your device information, location, usage data, and IP address, to analytics-based technologies to assist with personalization, advertising, and marketing. These technologies capture how you interact with Granum’s websites through behavioral metrics to improve and market our Services.
Business Partners
From time to time, Granum may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from Granum, Granum may share Personal Information collected in connection with your purchase or expression of interest with our joint promotion partner(s).
Granum does not control our business partners’ use of the Personal Information we collect, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to purchase or express interest in a jointly offered product or service.
Granum does not share Attendee Data with business partners unless: (1) you specifically opt in to such sharing via an event registration form; or (2) you attend a Company event and have your attendee badge scanned by a business partner. If you do not wish for your information to be shared in this manner, you may choose not to opt in via event registration forms and elect not to have your badge scanned at Company events. If you choose to share your information with business partners in the manners described above, your information will be subject to the business partners’ respective privacy policies.
Customers
If you are a Customer Employee or a Client (or personnel of a Client), we share Personal Information that the Services collect on behalf of Customer with the Customer. The Customer’s privacy policy governs the use by Customer of any Personal Information about Customer Employees or Customer’s Clients.
Compelled Disclosure
Granum reserves the right to use or disclose Personal Information provided if required by law or if Granum reasonably believes that use or disclosure is necessary to protect and defend Granum’s or others’ rights or property, to comply with a judicial proceeding, court order, or legal process, or to enforce agreements you enter with Granum.
Business Transactions
Your Personal Information may be transferred to another company in connection with a merger, reorganization, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.
Aggregated Data
We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.
With your Consent
Granum may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them.
SMS/Text Messages and Opt-Out
We will not share your mobile information with third parties without your explicit consent, except as required by law. We also will not sell your mobile information to third parties. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.
If you are receiving text messages from us and wish to stop receiving them, you may opt-out at any time by responding with either “STOP” or “UNSUBSCRIBE” to the number from which you received the message.”
Granum and the Services are controlled and operated from the United States. To facilitate Granum’s global operations, Granum may transfer and access Personal Information from around the world, including the United States. This Privacy Policy shall apply even if Granum transfers Personal Information to other countries. If you are an individual from Canada or any other jurisdictions with laws or regulations governing Personal Information collection, use, and disclosure that differ from United States laws, please be advised that we store the information we collect in the United States. . By visiting or using our Services, you are consenting to the transfer of your information from your jurisdiction to the United States.
Granum offers Visitors, Customers, and Attendees a means to choose how Granum uses the Personal Information provided. You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of Granum’s marketing emails. Additionally, you may send a request specifying your communications preferences to [email protected]. Customers cannot opt out of receiving transactional emails related to their account with Granum or the Services.
If you would like to make a request, cancel your account, or request we delete or no longer use your account information to provide you Services, contact us at [email protected] or make changes to any user profile information connected to your account as described in this Section.
Customers may update or change their registration information by editing their user or organization record. To update a user profile, please login to https://www.granum.com with your Granum username and password and click “Admin” and then click “Users.” To update an organization’s information, please login to https://www.granum.com with your Granum username and password and select “Admin” and then select “Company.”
Attendees may update or change their registration information on the event’s Web site after logging in. To update Billing Information or have your registration information deleted, please email [email protected]. To discontinue your account and to have information you maintained in the Services returned to you, please email [email protected].
Granum’s websites may contain links to other websites. The information practices or the content of such other websites is governed by the privacy policies of such other websites. While we endeavor to work with third parties that share our respect for user privacy, we are not responsible for the privacy policies or privacy practices of such third parties. Any information collected by third parties are not covered by this Privacy Policy. You are responsible for knowing when you are leaving the Granum’s websites to visit a third-party website, service, or application and for reading and understanding the terms of use and privacy policy statements for each such third party.
Granum uses reasonable security measures to protect Personal Information from unauthorized access, to maintain data accuracy, and to help ensure the appropriate use of Personal Information. Granum also implements a security method based on dynamic data and encoded session identifications, and Granum hosts its websites in a secure server environment that uses firewalls, intrusion detection systems, and other technology to prevent interference or access from outside intruders.
No Internet or e-mail transmission is ever fully secure or error free, however. We therefore cannot guarantee absolute security of your Personal Information, and we are not responsible for processes and networks that we do not control. Users assume the risk of security breaches and the consequences resulting from them. Please be careful in deciding what information you send to us via email or over the Internet. Customers are responsible for maintaining the security and confidentiality of their Granum logon credentials and passwords.
We retain the Personal Information we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed or removes themselves through any self-service tools offered to the user.
The Services provided are not directed to persons under 18. We do not knowingly collect Personal Information from children under 13. If you become aware that your child is accessing the Granum’s websites or Services and providing Personal Information without your consent, please contact us by using the information provided in the ‘Contacting us’ section below and we will take steps to remove any associated Personal Information.
California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed. If you are a California resident and want such a list, please send us a written request by email to [email protected] with “California Shine The Light Rights” in the subject line.
California Do Not Track Disclosure: We do not track our customers over time and across third party websites to provide targeted advertising on Granum websites and, therefore, Granum’s websites do not respond to Do Not Track (DNT) signals. We utilize Web Site Navigational Tools such as cookies on Granum’s websites to provide Granum advertisements on third party Web sites.
We may update this Privacy Policy from time to time to you to reflect changes in our information practices. If we make changes that materially affect your privacy rights, we will attempt to provide advanced notice (in nearly contemporaneous disclosures) or otherwise via the Granum’s websites and Services, or by some other means of contact so that you have a reasonable opportunity to review the changes before you continue to use Granum’s websites and Services. Your continued use of the Granum’s websites and Services after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy.
