3.4. Usage Restrictions. Customer will not: (a) make any Service or portion thereof available to, or use any Services for the benefit of, anyone other than Customer, (b) sell, resell, license, sublicense, distribute, rent or lease any Service, or include any Service in a service bureau or outsourcing offering, (c) use a Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to post, store or transmit any information concerning any other person or entity, including, but not limited to, material in violation of third-party privacy rights, (d) transmit Malicious Code, (e) interfere with or disrupt the integrity or performance of any Service or third-party data contained therein, (f) attempt to probe, scan, or test the vulnerability of an our system or network or breach any security or authentication measures, (g) attempt to gain unauthorized access to, or tamper with, any Service or its related systems or networks, our computer systems, or the technical delivery systems of our providers, (h) avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by us or any of our providers or any other third party (including another user) to protect the Services or any of the content on the Services, (i) permit direct or indirect access to or use of any Service in a way that circumvents a contractual usage limit, (j) copy a Service or any part, feature, function or user interface thereof, (k) copy, “scrape,” “crawl” or “spider” any pages or other content in the Services, (l) frame or mirror any part of the Services, (m) access any Service in order to build a competitive product or service or otherwise use the Services and/or the Content (defined below) for any revenue-generating endeavor or commercial enterprise, (n) attempt to decipher, decompile, disassemble, or reverse engineer any Service or any of the software used to provide the Services (except to the extent such restriction is permitted by law), (o) access the Services for purposes of monitoring availability, performance or functionality, or for any other benchmarking or competitive purposes, (p) violate any local, state, provincial, national, or other law or regulation, or any order of a court, (q) post, upload, publish, submit, or transmit any material that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances, (r) display, mirror or frame the Services, or any individual element within the Services, Granum’s name, any Granum trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Granum’s express written consent, or (s) advocate, encourage, or assist any third party in doing any of the foregoing.
